Red Flag Warning: States Confiscating Guns by Ignoring Fourth Amendment

An assortment of new restrictions on the Second Amendment in Florida also launched an attack on the Fourth Amendment, as well. As The New American noted last week, Florida’s new “red flag” law abrogates the Fourth Amendment on the way to violating the Second Amendment:

Simply put, someone who thinks someone else might be a danger to himself or others can present his arguments to a judge who then, based upon those arguments, is free to decide whether the state (police armed with guns and badges) can forcibly remove privately and legally owned firearms from that person’s possession. The “red flag” provisions do not allow the person charged to defend himself or even to know who his accuser might be. Further, he must prove his innocence in order to get his confiscated firearms returned to him. He is “guilty until he proves himself innocent.”

All in violation of the Fourth Amendment, which states: “The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”

Jonas Oransky, deputy director of Michael Bloomberg’s Everytown for Gun Safety, was delighted, calling the adoption of such laws a “new frontier” in the long war against private gun ownership in America:

The Minority Report is Now a Reality

Movie buffs will remember the 2002 science fiction film Minority Report based on a short story written by Philip Dick. Set in 2054 in Washington, D.C., a division of the local police department called PreCrime would arrest individuals based on crimes that they were going to commit. The precriminals were targeted by three psychics called “precogs.”

That “PreCrime” unit is now called the Crisis Response Squad, is part of the Seattle Police Department, and is now arresting precriminals based on testimonies from family members, friends, former wives or husbands, and even former roommates. This isn’t 2054, but 2018.

Why Didn’t Politifact Jump on the “18 Mass Shootings” Lie as Well?

Politifact, the fact-checking website run by the Tampa Bay Times, was quick to discredit the blatantly false headline, “Michelle Obama: Florida shooting is clearly Trump’s fault, these shootings are happening constantly since he became our president” offered by an alt-right blogger.

Politifact searched for confirmation and, finding none, informed its readers “that former first lady Michelle Obama did not make those remarks … in any format whatsoever.” No website that picked up the story “should be trusted,” added the fact-checking service.

Wouldn’t that include Everytown for Gun Safety, which promoted the lie that there have been 18 mass shootings in the country since the first of the year? Wouldn’t those MSM outlets that picked it up without question also fairly and reasonably not “be trusted” either? John Lott, the founder of the Crime Prevention Research Center and author of bestseller More Guns, Less Crime, put the torch to the lie:

The New American reviewed what it knew about Nikolas Cruz, the Florida school shooter, on Thursday. Since then a lot more has been uncovered, some of it disturbing and totally unrelated to guns. Our previous article noted:

Cruz left abundant clues about his mental instability: gruesome pictures he published on social media of animals that he had brutally killed, claims that he wrote “Allahu Akbar” on Instagram, revelations that the FBI knew of his erratic behavior months ago when it was reported to them by one of Cruz’s classmates, the decision to expel him last year from the same school he attacked for “disciplinary” reasons, classmates being intimidated by him and avoiding contact with him because he was “weird” and a “loner,” and so forth.

But Cruz hadn’t lost control of his faculties:

Cruz carefully planned the assault. He entered the building near the end of the class day on Wednesday, wearing a gas mask and armed with smoke grenades and firearms. He set the grenades off and then triggered the fire-alarm system, which sent students scurrying into the halls where Cruz picked them off one by one with his rifle.

He wasn’t found and arrested until nearly two hours later, as he had left the building and deliberately blended into the crowd of fleeing students.

Police arrested him at his home about two hours after the attack.

Crazed Atheist Shoots Up Texas Church; Dems Call for Gun Control

Five years before Devin Patrick Kelley entered the First Baptist Church of Sutherland, Texas, on Sunday and opened fire on the 50 or so worshippers there, he had been court-martialed for “bad behavior.” That behavior consisted of at least two beatings of his wife and child, which resulted in him being confined for a year and demoted. He left the U.S. Air Force in 2014 with a dishonorable discharge. According to federal law, someone who receives a dishonorable discharge is not supposed to be able to purchase a gun, but Kelley had recently done just that, after filling out the federal paperwork as he was supposed to do. Kelley was an angry atheist, whom school acquaintances had been unfriending from Facebook because of his angry diatribes.

Kelley, clad in black and wearing a ballistic vest, entered the church around 11 a.m. on Sunday and opened fire with a semi-automatic rifle,

Here’s What 100 FBI Agents Know About the Las Vegas Shooter

It’s been a week since Stephen Paddock shot and killed nearly 60 people at a concert in Las Vegas and wounded another 500 before taking his own life. Since then, 100 FBI agents and other investigators have been combing Paddock’s background to try to determine a motive. After spending thousands of man-hours searching his computers, residence, hotel room, vehicles, and banking connections, and checking into his mental health records, criminal behavior, and finances, they have uncovered an immense amount of information. They have interviewed hotel employees and viewed hours of videotape from hotel surveillance cameras. They’ve learned a lot, but they still don’t have a motive.

And now they’re asking the public for help.

Gun Sales Set Records, Likely to Continue

According to the FBI, more than two million gun-purchase background checks were conducted in April, 400,000 more than in April a year ago. In fact, every month since last May, background checks have set new records, putting 2016 on track to beat 2015 for the number of checks conducted by the National Instate Criminal Background Check System (NICS).

In its report the FBI noted that there is no direct one-to-one correlation between background checks and gun sales, but it’s close. Especially if one tracks the performance of stocks of Sturm Ruger & Co. and Smith & Wesson in the last 12 months.

Medical Examiner: Oregon Shooter Committed Suicide

On Saturday the Oregon state medical examiner’s office ruled that Chris Harper-Mercer, the shooter who killed nine people and injured more than a dozen others at Roseburg’s Umpqua Community College last Thursday, died by his own hand and not as the result of a shootout with police, as some initially surmised. Despite being heavily armed, the 26-year-old apparently turned one of his weapons on himself rather than engage the police in a firefight.

House Passes bill to Increase Funding for Background Checks

Late last Thursday the House voted, 260-145, to increase federal grant money to states to improve their reporting to the National Instant Criminal Background Check System, or NICS. It was a textbook case of revolutionary parliamentarianism at work.

Less than one week after the Isla Vista, California, shootings which left seven people dead and 13 wounded, the House voted to increase funding by $19.5 million to assist the states in their data collection and entry into the federal gun registry system. It was all for good reasons, according to Rep. Mike Thompson (D-Calif.), who helped sponsor the amendment:

The president thinks he can keep something like the Fort Hood shooting that took place on Wednesday afternoon from happening again. As a starting point, he called out his troops to find out what happened:

Following the second Fort Hood massacre in five years, the post’s commanding general, Lt. General Mark Milley, told reporters on Thursday that the root cause of the attack was attacker Ivan Lopez’s mental illness:

We have very strong evidence that [Lopez] had a medical history that indicates an unstable psychiatric or psychological condition. We’re going through all records to ensure that is, in fact, correct. But we believe that to be the fundamental underlying causal factor [in the massacre].

On Saturday, the first anniversary of the ghastly unprovoked attack on innocents at the Sandy Hook Elementary School in Newtown, Connecticut, last year, anti-gun rallies are being held in 35 states in an attempt to energize the push for more gun controls. Shannon Watts, the founder of Moms Demand Action for Gun Sense in America which will be ringing bells across the land in its “Silence No More” memorial rallies, said:
