Preet Bharara’s resume is impressive. Born in India and raised in Eatontown, New Jersey, he graduated from Ranney School, an independent, highly-regarded college preparatory school, in 1986 as valedictorian of his class. From there he went to Harvard College, graduating magna com laude (with great honor) four years later. He received his J.D. (juris doctor) in 1993 from Columbia Law School where he served on the Columbia Law Review.

After a stint as Sen. Chuck Schumer’s chief counsel, he served as an assistant U.S. Attorney in Manhattan for five years, successfully prosecuting bosses of the Gambino and Columbo crime families.

When he was nominated for U.S. Attorney for the Southern District of New York by President Obama in 2009, he breezed through Senate confirmation with no dissents.

SEC Exposes Largest Insider Trading Scheme Ever

Mathew Martoma, age 38, was arrested at his home in Boca Raton, Florida, early Tuesday morning by the FBI and charged with insider trading. U.S. Attorney Preet Bharara, whose face appeared on the cover of Time magazine last February as the “man who is busting Wall Street,” was positively joyful in announcing the bust:

The charges unsealed today describe cheating coming and going — specifically, insider trading first on the long side, and then on the short side, on a scale that has no historical precedent.

As a result of the blatant corruption of both the drug research and securities markets alleged, the hedge fund [for whom Martoma worked at the time] made profits and avoided losses of a staggering $276 million, and Martoma himself walked away with a $9 million bonus for his efforts.

At a press conference, Bharara continued:

Mathew Martoma and his hedge fund benefitted from what might be the most lucrative inside tip of all time. This is certainly the most lucrative insider-trading scheme ever charged.

It certainly exceeded the amounts involved in the cases of Raj Rajaratnam and Rajat Gupta, both of whom are serving serious jail time for their convictions in insider-trading schemes. The Coming of the Universal Financial Transaction Tax

In the clearest indication yet, a high French government official confirmed last week that an FTT—Financial Transaction Tax—will be implemented by the European Union by the end of 2012, a year earlier than planned. Jean Leonetti, France’s minister for European affairs, said on television that “This is on the program for the next European summit [on January 30th]. Nicolas Sarkozy and Angela Merkel have decided on this and it will be put in place before the end of 2012.”

The tax would be levied, initially at least, on every financial transaction taking place by any entity with a connection to the Eurozone, and would be levied at the rate of 0.1 percent on shares of stock and bonds, and 0.01 percent on all derivatives transactions. It is estimated that the FTT would cover about 85 percent of all transactions between financial institutions such as banks, investment firms, insurance companies, pension funds and hedge funds. It is expected to raise, in the beginning, about $70 billion annually to help fund the EU.

It’s being touted as punishment for the banks that were allegedly instrumental in causing the economic meltdown, but would have no impact on ordinary citizens or small businesses. According to the European Commission, the FTT “would help to reduce competitive distortions in the single market, discourage risky trading activities [such as high frequency trading and highly leveraged derivatives contracts] and complement regulatory measures aimed at avoiding future crises.”

The announcement by Kaspar Villiger, Board Chairman of UBS (Union Bank of Switzerland), that CEO Oswald Grübel had resigned on Saturday caught many by surprise, partly because just the day before he had said he had the board’s complete support. According to Villiger, “The Board regrets Oswald Grübel’s decision. Oswald Grübel feels that it is his duty to assume responsibility for the recent unauthorized trading incident.” He added:

What’s Wrong with Insider Trading? Ask Raj Rajaratnam

When Raj Rajaratnam, founder of Galleon Management, was convicted on all 14 counts of insider trading earlier this month, it made the phones ring in lawyers’ offices all across the country. Rajaratnam was only one of 47 people charged but he was by far the biggest fish caught in the net set by United States attorney for Manhattan, Preet Bharara. It took Bharara’s office 9 months of wire-tapping Rajaratnam’s phone, and 18 months of additional investigative work to get the convictions, and Bharara was ecstatic: “The message today is clear–there are rules and there are laws, and they apply to everyone, no matter who you are or how much money you have.”
