In a Surprise Move, DOJ Asks Judge to Dismiss All Charges Against NJ Senator Menendez

The Justice Department, which just weeks earlier said it was planning on retrying New Jersey’s senior Senator Bob Menendez on corruption charges, asked a district court judge on Wednesday to “dismiss the … indictment[s]” against him, and hours later the judge complied. Menendez’s sigh of relief was palpable in his statement following the dismissal:

From the very beginning, I never wavered in my innocence and my belief that justice would prevail. I am grateful that the Department of Justice has taken the time to reevaluate its case and come to the appropriate conclusion.

“From the very beginning” Menendez’s political career has been plagued with charges of corruption, graft, illegal influence peddling, and lying. Just because the DOJ has decided not to press its case against him doesn’t mean he’s innocent, just lucky.

Following a hung jury in November, Menendez has been holding his breath, waiting for the date of his retrial to be announced this week. The dismissal caught many by surprise, including former federal prosecutor Robert Mintz:

The New York Times Masks the Truth in Venezuela

After five months and 5,000 words, the journalists at the New York Times refused to use the word “socialism” as the cause of the horrors they uncovered in Venezuela. Instead, Venezuela’s problems are the result of years of “economic mismanagement” instead.

What they found was horrific, and more than sufficient to prove the point: socialism destroys, maims, and kills. Its worst atrocities are inflicted on the defenseless: the elderly and the very young. The intrepid journalists focused on the latter, and what they found was predictable and heartrending: babies in Venezuela are dying of malnutrition at rates seen only in refugee and concentration camps. Emergency rooms are filled to overflowing by mothers with starving infants at their breasts while others are being turned away. Doctors told the journos that children arrive at the hospitals weighing the same as when they were born. Infant mortality rates are soaring, and there’s little doctors can do about it. Said the authors: “The statistics that have come out are staggering. In the Ministry of Health’s 2015 report, the mortality rate for children under four weeks old had increased a hundredfold [while] maternal mortality had increased nearly fivefold.”

After eight weeks of listening to more than 50 witnesses in the corruption trial of New Jersey Senator Bob Menendez (D) and his friend, Florida eye surgeon Salomon Melgen, the jury couldn’t reach a verdict. This forced the judge in the trial — who has been involved in it since 2015 when the Justice Department first brought charges — to declare a mistrial: “I find that you [the jury] are unable to reach a verdict and that further deliberations would be futile and that there is no alternative but to declare a mistrial.”

The red flag of socialism is red for a very good reason.

The end stages of socialism in Venezuela are forcing citizens to do anything they can to obtain food for themselves and their families, including risking their lives. Mariana Revilla, a medical doctor reduced to making midnight excursions over 60 miles of open ocean to feed her family, was making her fifth trip to Trinidad when her boat capsized, costing her her life and the lives of two others assisting her.

Her boat contained seven tons of flour, sugar, and cooking oil that she had obtained through barter at one of the west coast towns of Trinidad, exchanging them for the tons of fresh shrimp she had brought with her. Others making the midnight trips would take with them anything of value to exchange for food and basic necessities, making the boats look like a floating garage sale: plastic chairs, house doors, ceramic cooking pots, and even exotic animals such as iguanas and macaws to trade for food.

Socialists promise that such things could never happen in the “paradise” they are determined to build. Americans for Prosperity (AFP) compared the promises to the reality which Venezuelans are now facing daily:

In Joshua Stanton’s Arsenal of Terror – North Korea, State Sponsor of Terrorism, prepared in 2015 for The Committee for Human Rights in North Korea, he summarizes the depths of depravity North Korea’s leaders have sunk to in order to oppress that sad country’s citizenry and threaten its neighbors:

North Korea’s sponsorship of terrorism is a threat to human rights in several regions of the world today, including the United States. It involves the sale or transfer of weapons to foreign terrorist organizations.

 

It involves threats to North Korean émigrés and refugees, and South Korean human rights activists, who have become targets for kidnapping and assassination by North Korean agents.

 

More recently, it involves threats to freedom of expression in the United States, and represents a growing threat to the safety of South Korea’s civilian population.

Otto Warmbier, a University of Virginia student who was detained by North Korea for a year and a half, was released to the US in a coma last week and died Monday. When Stanton learned that Otto Warmbier’s death was likely caused by oxygen deprivation and not botulism as claimed by his captors, he wasn’t surprised. An attorney with 18 years of both military and civilian experience in the “art” of North Korean torture techniques, and a frequent testifier before congressional committees about North Korea’s atrocities, Stanton wrote:

Social Security Disability Fraud Hides the Biggest Fraud of All

The Social Security Administration’s Office of the Inspector General reported in 2015 that nearly half of the nine million people receiving SSI (Supplemental Security Insurance) benefits were being overpaid, running up $17 billion in excess disbursements over the previous 10 years.

Such overpayments were just the beginning of the story. On Monday, a former Kentucky attorney pleaded guilty to filing more than 1,700 false SSI disability claims in a scheme that netted him millions in fees that he lavishly dished out to his co-conspirators: a Social Security administrative law judge and a psychologist, among others. In his plea bargain, former attorney Eric Conn fingered Judge David Daugherty (whom he said birthed the scheme originally) and Dr. Alfred Adkins.

The fees that Conn collected ran into the millions, while Social Security dished out some $550 million in benefits to beneficiaries who willingly participated, some of them saying later that they didn’t really know what was happening but were happy to pay Conn $200 in cash under the table for his “advice” and assurance that their claims would be approved.

A former Kentucky attorney pleaded guilty on Monday to filing more than 1,700 fake disability applications under Social Security’s Supplemental Security Income (SSI) program. The complex scheme netted Eric Conn millions in kickbacks while costing SSI an estimated $550 million in phony benefits paid out to unsuspecting beneficiaries.

Conn’s plea bargain accused his co-conspirators, psychologist Alfred Adkins and Social Security Administrative Law Judge David Daugherty along with other unnamed individuals, of working with him in the scam. Conn claimed that the scheme was hatched originally by Daugherty.

How Trump Can Accelerate the Failure of ObamaCare

With the withdrawal of a House bill to repeal and replace ObamaCare, Market Watch explored the options the Trump administration has to hasten the collapse of the ACA. ThinkProgress has reported that the process has already started.

House Speaker Paul Ryan, in announcing the withdrawal of the bill on Thursday,  said that ObamaCare would remain in place “for the foreseeable future.” He didn’t define that future.

The government healthcare plan is already fraying around its edges. Premiums are rising far beyond original estimates, partly due to the withdrawal of major health insurers UnitedHealth Group, Humana, and Aetna from offering coverages. And those remaining in the market have only until June 21 to submit their bids for offering coverages starting in November. But without certainty, a stable market and a broader pool made up more of healthy customers than those who are sick, those bids are almost certain to push premiums even higher.

Trump’s head of the Department of Health and Human Services (HHS) Tom Price, an opponent of the ACA, has already ordered the ending of the promotion of ObamaCare, which has caused a drop-off of enrollment of 400,000 compared to last year.

Three Charged in $1 Billion Medicare/Medicaid Fraud Scheme

Last Friday the Justice Department charged a Miami-area healthcare operator, a hospital administrator, and a physician’s assistant with conspiracy involving submitting fraudulent bills to Medicare and Medicaid exceeding, for the first time, $1 billion.

The three included Philip Esformes, the owner of more than 30 Miami-area nursing and assisted-living facilities, hospital administrator Odette Barcha, and physician assistant Arnald Carmouze. They were charged with money laundering, conspiracy to defraud the U.S. government, and receiving kickbacks, along with other charges.

The conspiracy had been going on for 14 years, and came to a end with the help of the Medicare Fraud Strike Force (MFSF), which began investigating healthcare fraud in March 2007. Since that time, nearly 3,000 defendants,
